Terms of Service

Htech AI lets you create a website or an online store from ready-made designs. Our AI writes and adapts the texts for your business, you can change the site by writing in a chat, and we host the result at a free address (for example yourbusiness.htechai.site) or at your own domain. Htech AI also includes tools to sell products online and a Content Studio that writes ideas and texts for social media posts. We never publish anything on your social media accounts.

Some features are marked "coming soon" and are not available yet. We continuously improve Htech AI, so features may change over time.

• You must be at least 18 years old and use Htech AI for your business or professional activity.
• The information you give us must be accurate, and you must keep it up to date.
• Keep your password safe and do not share your login. You are responsible for everything done with your account.
• Tell us straight away at office.htechinternational@gmail.com if you think someone else has accessed your account.
• If you invite other people to your business, you are responsible for what they do in it.

Each plan includes the features and monthly limits shown on our pricing page. New accounts can try Htech AI free for 14 days, without a card.

• Prices are shown without taxes. VAT or sales tax is added at checkout where it applies.
• Subscriptions renew automatically at the end of each monthly or yearly period until you cancel. You can cancel at any time; the cancellation takes effect at the end of the period you have already paid for.
• Payments already made are not refunded for unused parts of a period, unless the law of your country requires otherwise.
• Extra credits do not expire while your account exists, have no cash value and cannot be refunded or transferred.
• If we change our prices, we will tell you at least 30 days before the new price applies to your next renewal.
• Payments are processed by Stripe. We never see or store your full card number.

If a payment fails or a paid period ends without renewal, we may limit your account or take your sites offline. We will warn you before we delete any of your data for this reason.

Everything you add to Htech AI, such as your logo, photos, texts, products and prices ("Your Content"), stays yours.

You give us a worldwide, non-exclusive, royalty-free permission to store, copy, adapt, display and publish Your Content, and to send it to our service providers (including our AI provider), only as needed to run Htech AI for you. This permission ends when you delete Your Content or your account, except for copies we must keep by law.

You confirm that you own Your Content or have the right to use it (for example the right to use a photo or a logo), and that it is lawful, accurate and does not infringe anyone else's rights.

Htech AI uses artificial intelligence to write texts, suggest changes and, in the future, to create images and videos. Please keep in mind:

• AI results are created automatically and can be wrong, incomplete or misleading. Always check them before you publish them, especially prices, opening hours, contact details, health, legal or financial information, and any promises about your products or services.
• You are responsible for what you publish on your website, in your store and on social media.
• Similar instructions can produce similar results for other users, so we cannot promise that AI results are unique, and in some countries they may not be protected by copyright. To the extent we have any rights in the results created for you, we transfer them to you.
• Do not use AI to create fake reviews, fake testimonials, false statistics or other misleading claims.
• Where the law or a social media platform requires it, label realistic AI-generated images and videos as AI-generated.

The example designs use photos from free stock photo libraries under their own licences, only as placeholders. Replace them with your own photos when you can.

You may not use Htech AI to:

• break the law or help others break it;
• deceive people, for example with fraud, phishing, fake shops, pyramid schemes or impersonating another person or business;
• sell or promote illegal, counterfeit, stolen or dangerous goods or services;
• publish content that sexually exploits minors, sexually explicit content, violent extremist content, or content that promotes hatred, harassment or violence;
• infringe copyrights, trademarks or other rights of others;
• send spam or collect personal data without a legal basis;
• upload malware, attack, overload or try to get around the security or the limits of Htech AI, or access other customers' data;
• copy, scrape or resell Htech AI or its designs, or use it to build a competing product or to train AI models.

The usage policies of our AI provider (OpenAI) also apply to the content you ask our AI to create. We may automatically check the texts you send to our AI and refuse requests that break these rules.

If you sell through Htech AI, you are the seller and your customers buy from you, not from us. You are responsible for your products, prices, descriptions, taxes, delivery, returns, refunds, customer service and for following the consumer protection, tax and other laws that apply to your sales. This includes publishing the information your customers must receive, such as your business details, your terms of sale and your own privacy policy.

When card payments for stores become available, they will be processed by Stripe through an account in your name, and Stripe's own terms will apply to it.

When your website or store collects personal data about your visitors or customers (for example the name, email, phone number and delivery address in an order), you are the controller of that data and we process it on your behalf as your processor. For this data:

• we process it only to provide Htech AI as you use it, which counts as your instructions;
• people who work on Htech AI are bound to confidentiality;
• we protect it with appropriate technical and organisational security measures;
• we use the service providers listed in our Privacy Policy as sub-processors, under contracts that protect the data, and you authorise their use; we will update the list before we add a new one;
• we help you answer your customers' requests to exercise their rights, and we tell you without undue delay if we become aware of a personal data breach that affects your data;
• when you delete your store, your site or your account, we delete this data, except copies we must keep by law; you can export your data before that;
• we give you the information needed to show that these obligations are met.

Where data is transferred outside the European Economic Area or the United Kingdom, we use the safeguards described in our Privacy Policy. You must have a legal basis for collecting your customers' data and give them your own privacy notice.

Each site gets a free address on htechai.site. We may refuse or take back an address that is misleading, infringes someone's rights or is reserved for us.

If you connect your own domain, it stays yours. You are responsible for registering and renewing it and for its settings at your domain provider. To serve your site securely, we may obtain security (SSL) certificates for your domain through our hosting provider.

We work hard to keep Htech AI and your sites online and fast, but we cannot promise that they will always be available or free of errors. We may need to pause the service for maintenance or security reasons. We may add, change or remove features; if a change significantly reduces a paid feature you use, we will tell you in advance.

You can delete your account at any time in Settings. This permanently deletes your businesses where you are the only owner, with their websites, stores, orders, files and content. Download your data first if you need it.

We may remove content, unpublish a site or suspend or close an account if it breaks these Terms or the law, puts other people or the service at risk, or if we are required to do so. Where reasonable, we will tell you first and give you a chance to fix the problem.

Htech AI, including its software, designs, templates, illustrations and brand, belongs to Htech International LLC or its licensors. While you use Htech AI, we give you a personal, non-exclusive and non-transferable right to use our designs and templates for your own sites on Htech AI. You may not copy them for use outside Htech AI.

Htech AI relies on other companies, such as Cloudflare (hosting), Supabase (database and accounts), OpenAI (AI) and Stripe (payments), and works with your own domain provider. We are not responsible for services that you use directly with other companies, and their own terms may apply to them.

Htech AI is provided "as is" and "as available". To the extent the law allows, we do not give any warranty that it will meet your needs, bring you customers or sales, or that AI results will be accurate. Nothing in these Terms limits rights that you have under mandatory consumer protection law.

To the extent the law allows, we are not liable for indirect or consequential damages, or for lost profits, revenue, business opportunities or data. Our total liability for all claims related to Htech AI is limited to the higher of the amount you paid us in the 12 months before the claim and 100 euros (or 100 US dollars if you pay in dollars).

These limits do not apply to death or personal injury caused by our negligence, to fraud, to damage we cause intentionally or through gross negligence, or where the law does not allow liability to be limited.

If someone makes a claim against us because of Your Content, your sales, your use of Htech AI against these Terms or your breach of the law, you will cover the reasonable costs and damages that result from it, as far as the law allows.

We may update these Terms, for example when we add features or when the law changes. For important changes we will tell you by email or in your dashboard at least 30 days before they take effect, except for changes required by law or needed for security, which may apply sooner. If you do not agree with the new Terms, you can delete your account before they take effect. If you keep using Htech AI after that date, the new Terms apply.

These Terms are governed by the laws of the State of Delaware, USA, and disputes will be decided by the courts of Delaware. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and you may also bring a claim in the courts of that country. Before going to court, please contact us: most problems can be solved quickly.
